Do I need a buyer's agent to buy a home in New Jersey?+
You can buy without one. The listing agent represents the seller, so having your own agent means someone is representing your interests, from the first showing through closing. The Consumer Information Statement explains the kinds of business relationships available in New Jersey.
Do I sign an agreement before touring homes?+
In most cases, yes. Agents in New Jersey now use a written buyer representation agreement before showing you homes. It sets out the services your agent will provide, how long the agreement runs, and how your agent is paid. Read it with your agent before you sign; if anything in it is unclear, that is worth confirming with your broker or your own attorney.
How is a buyer's agent paid?+
Compensation is set out in your buyer agreement and is negotiated between you and the brokerage. It can be paid by the seller, covered by a seller credit to you at closing, or paid by you, depending on the deal. Can the same agent represent both the buyer and the seller?+
New Jersey allows one agent to represent both sides with written consent from each. The Consumer Information Statement describes how. If it could come up on a home you like, it is worth confirming with your broker how it would work before you make an offer.
